All information provided by this service is for general informational purposes only. This service does not constitute legal services within the meaning of § 2 of the German Legal Services Act (Rechtsdienstleistungsgesetz — RDG).

1. Acceptance of Terms

By accessing or using ColossalLaw ("the Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

2. Service Provider

The Service is operated by the entity identified in our Impressum (§ 5 DDG).

3. Description of Service

ColossalLaw is an AI-powered legal information tool that provides general legal analysis and information across multiple jurisdictions. The Service uses artificial intelligence (including Google Gemini) and retrieval-augmented generation (RAG) to analyze legal questions and provide educational responses.

4. NOT Legal Advice (Keine Rechtsberatung)

The Service does NOT constitute legal advice or legal services. Specifically:

ColossalLaw is not a law firm (Rechtsanwaltskanzlei) and does not provide legal representation.
The Service does not constitute legal services (Rechtsdienstleistungen) within the meaning of § 2 RDG (Rechtsdienstleistungsgesetz). It provides only general legal information (allgemeine Rechtsinformationen).
No attorney-client relationship (Mandatsverhältnis) is created by using this Service.
AI-generated responses may contain errors, hallucinations, outdated information, or misinterpretations of the law.
You should ALWAYS consult a qualified, licensed attorney (Rechtsanwalt/Rechtsanwältin) before making any legal decisions.
You should NOT rely on this Service as your sole source of legal information.
The Service does not guarantee the accuracy, completeness, timeliness, or applicability of any information provided.

5. Prohibited Use of Personal Data

You agree NOT to input any personal or identifying information into the Service, including but not limited to:

Real names of individuals
Phone numbers, email addresses, or physical addresses
Government-issued identification numbers (Personalausweis, passport, tax ID)
Financial account information (IBAN, credit card numbers)
Any data that could identify a specific individual

Instead, use anonymous references such as "Person A", "Company B", "Landlord", "Tenant", etc. While the Service includes an automated PII detection and removal system, this system is not infallible. You are solely responsible for anonymizing your queries before submission.

6. User Accounts & Authentication

The Service uses Google OAuth for authentication. We use your Google account solely for login verification. We do NOT store your email address or Google profile data. Only a pseudonymous, opaque user identifier is retained for session management. See our Privacy Policy for details.

7. Data Handling

Chat History: Your conversation sessions are stored in pseudonymized form to provide continuity. They are associated with a pseudonymous user ID, not your email.
PII Removal: The system automatically detects and removes personal data from queries before processing, but cannot guarantee 100% detection.
AI Processing: Your PII-redacted queries are processed by Google Gemini AI models. Data processing agreements (AVV) are in place with Google Cloud.
No Sale of Data: We do not sell, share, or monetize your query data.

8. Limitation of Liability (Haftungsbeschränkung)

To the extent permitted by German law (§§ 307 ff. BGB):

The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
We are not liable for any damages arising from your use of, or reliance on, the Service or its outputs.
We are not liable for any decisions you make based on information provided by the Service.
This limitation does not apply to damages caused by intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit), or to liability under mandatory statutory provisions (e.g., Produkthaftungsgesetz).
For paid features: Our total liability shall not exceed the amount you paid for the Service in the preceding 12 months.

9. Indemnification

You agree to indemnify and hold harmless ColossalLaw, its operators, and affiliates from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Acceptable Use

You agree NOT to use the Service to:

Engage in any unlawful activity or promote illegal actions
Attempt to extract or reverse-engineer the AI models or training data
Overwhelm the Service with automated or excessive requests
Impersonate a licensed attorney (Rechtsanwalt) or law firm
Present AI-generated content as professional legal advice to third parties
Input personal data of third parties without their consent

11. Intellectual Property

The Service, its design, code, and branding are the property of ColossalLaw. AI-generated responses are provided for your personal use. You may not reproduce or redistribute them commercially without attribution.

12. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Service interface. Continued use of the Service after changes constitutes acceptance of the new Terms. We will update the "Last updated" date above when changes are made.

13. Termination

We may suspend or terminate your access to the Service at any time, for any reason, with reasonable notice where possible. Upon termination, all associated session data will be deleted.

14. Governing Law & Dispute Resolution (Anwendbares Recht)

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany. For consumers (Verbraucher) within the EU, mandatory consumer protection provisions of your country of residence apply in addition. The place of jurisdiction is Berlin, Germany, unless mandatory statutory provisions require a different jurisdiction.

The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are not obligated and not willing to participate in a dispute resolution procedure before a consumer arbitration board.

15. EU AI Act Transparency Notice

In accordance with the EU Artificial Intelligence Act (Regulation 2024/1689), we disclose that this Service uses generative AI systems (Google Gemini). Responses are machine-generated and should be verified by qualified professionals. The AI may produce inaccurate, biased, or outdated results. This system is classified as a limited-risk AI system requiring transparency obligations.

16. Severability (Salvatorische Klausel)

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely approximates the economic intent of the invalid provision.

17. Paid Services & Subscriptions

ColossalLaw offers the following paid options:

Free Tier: 5 legal analysis requests upon registration, at no cost.
Request Pack: €5 (incl. VAT) for 5 additional requests. One-time purchase, no expiration.
Monthly Subscription: €20/month (incl. VAT) for 50 requests per billing cycle. Unused requests do not carry over. Auto-renews monthly.

Payments are processed securely by Lemon Squeezy (Lemon Squeezy LLC) as Merchant of Record. All prices include applicable VAT.

18. Widerrufsbelehrung (Cancellation Policy)

Widerrufsrecht für Verbraucher (Right of Withdrawal for Consumers)

Sie haben das Recht, binnen vierzehn Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen. Die Widerrufsfrist beträgt vierzehn Tage ab dem Tag des Vertragsschlusses.

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date of conclusion of the contract.

Ausübung des Widerrufsrechts (How to exercise): To exercise the right of withdrawal, you must inform us (see Impressum) of your decision to withdraw by an unequivocal statement (e.g., an email).

Folgen des Widerrufs (Consequences): If you withdraw, we shall reimburse all payments received from you without undue delay and no later than fourteen days from the day we received notification of your withdrawal. We will use the same means of payment as you used for the initial transaction.

Vorzeitiges Erlöschen (Early expiration): Das Widerrufsrecht erlischt bei digitalen Inhalten vorzeitig, wenn Sie ausdrücklich zugestimmt haben, dass wir mit der Ausführung des Vertrags vor Ablauf der Widerrufsfrist beginnen, und Sie Ihre Kenntnis davon bestätigt haben, dass Sie durch Ihre Zustimmung Ihr Widerrufsrecht verlieren. / The right of withdrawal expires prematurely for digital content if you have expressly consented to us beginning performance before the withdrawal period has expired and have acknowledged that you thereby lose your right of withdrawal.

19. Refund Policy

Request Packs: Refunds for unused request packs may be requested within 14 days of purchase by contacting us via the information in our Impressum. Used requests are non-refundable.

Subscriptions: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No pro-rata refunds are provided for partial months. Manage your subscription via the Lemon Squeezy customer portal.
